I looked it over for several minutes, and don't see how it could be, though I'm no legal expert. They appear to be up-front about what they do, including a "legal disclaimer" which reads...

SurfTheChannel is a simple resource site. All content visible on this site is located at 3rd party websites. SurfTheChannel is not responsible for any content linked to or referred from these pages.

SurfTheChannel does not host any content on it's Servers

All video links point to content hosted on third party webites. Users who upload to these websites agree not to upload illegal content when creating their user accounts. SurfTheChannel does not accept responsibility for content hosted on third party websites.

The site also posts the following statement about intellectual property...

This site (SurfTheChannel.com) respects the rights of others, and prohibits the use of the referenced material for any purpose other than that for which it is intended (where such use is lawful and free of civil liability or other constraint) and in such circumstances where possession of such material may have any adverse financial, prejudicial or any other effect on any third party.

In summary, it sounds to me like they have their bases covered, though as with P2P programs, that doesn't mean people can't do illegal things *using* the site.
